FAQ

Questions and answers

Is renting a room also a residential lease under Polish law?

Yes. Renting a room for living purposes is governed by the Civil Code and the Tenants' Rights Protection Act, including the deposit limit of 12× the rent. The difference is that the tenant uses only part of the flat.

How do I describe the common areas in the agreement?

Tick in the form which rooms the tenant may use – only the ones you select will appear in the agreement. If something is excluded from use, e.g. one room, don't tick it.

Does each flatmate sign a separate agreement?

Usually yes: a separate agreement per room makes settlements and termination easier. If several people rent one room together, add them as tenants of a single agreement – they are then jointly and severally liable.

Can the owner live in the same flat?

Yes, a room rental agreement also works when the landlord lives on site. In that case, write down the house rules and the use of the kitchen and bathroom especially carefully.
