Which agreement to choose?
All three templates cover rental for residential purposes.
Residential lease
The most common choice. The tenant is protected by the Tenants' Rights Protection Act (ustawa o ochronie praw lokatorów), and the landlord can terminate the agreement only on statutory grounds. Deposit of up to 12 times the rent.
Occasional lease (najem okazjonalny)
For a landlord who is a private individual and does not run a rental business. The tenant's notarial deed lets you recover the premises without a lengthy eviction lawsuit. Deposit of up to 6 times the rent.
Room rental
Rental of a single room with the right to use shared areas. Describe precisely which room and what the tenant may use.
Occasional lease
What an occasional lease requires
Without these elements the agreement will be an ordinary lease rather than an occasional lease, and the owner's protection is lost.
- The landlord is a private individual and the owner of the premises, and does not run a business renting out premises.
- The agreement is in writing, for a fixed term of no more than 10 years.
- The tenant's statement in the form of a notarial deed: submitting to enforcement and undertaking to vacate the premises on demand.
- Designation of a substitute residence where the tenant will live in case of enforcement.
- A statement from the owner of the substitute residence consenting to the tenant living there, with an officially certified signature (e.g. by a notary).
- A deposit of no more than 6 times the monthly rent.
- Notification of the agreement to the tax office (urząd skarbowy) competent for the owner's place of residence within 14 days of the start of the lease.
The generator will add to the agreement clauses on the notarial deed, the substitute residence and the notification to the tax office (urząd skarbowy). You must arrange the notarial deed and the signature certification in person.

FAQ
Frequently asked questions about lease agreements
Is the generator free, and do I need to log in?
Yes, it is free and works without logging in. Your data is saved only in your browser and we don't send it to a server. If you have a listing on Flats.pl and are logged in, you can fill in the premises details with one click.
Is the generated agreement valid?
The agreement becomes binding once both parties sign it. A lease for longer than one year should be in writing, otherwise it is deemed concluded for an indefinite term. An occasional lease requires written form and attachments, including a notarial deed. This template is for information only and does not constitute legal advice.
What is the maximum deposit for an apartment?
In an ordinary lease the deposit cannot exceed 12 times the monthly rent, and in an occasional lease 6 times. The deposit is returned within a month of the premises being vacated, after deducting the landlord's claims.
How do I terminate a fixed-term lease?
Only in the cases the agreement lists. That is why the generator asks you to select the termination reasons for both parties. Without them the agreement runs until the end of the term, unless the parties end it by mutual agreement.
Do I have to notify the tax office (urząd skarbowy) of a lease agreement?
Only an occasional lease requires a notification within 14 days. With any lease, the owner pays tax on the income: in 2026 private rental is taxed with a flat rate of 8.5% up to 100,000 PLN of income per year and 12.5% on the excess.
Can I prepare the agreement in two languages?
Yes. Choose a bilingual version: Polish with an English, Ukrainian, German, Spanish or Russian translation. In the PDF the Polish text is in the left column and the translation in the right, clause by clause. The Polish version is binding; the translation is for reference only.
