FAQ

Questions and answers

Does a flat rental agreement have to be in writing?

The law requires written form, and an agreement for more than one year concluded without it is deemed concluded for an indefinite period. Print the PDF in two copies (or as many as there are parties) and sign each of them.

Fixed-term or indefinite – which should I choose?

A fixed-term agreement gives both parties predictability, but it can only be terminated in the cases listed in the agreement – the generator will ask you to choose them. An indefinite agreement can be terminated by the tenant with notice, and by the landlord only on statutory grounds.

How high can the deposit be?

In a standard lease, at most 12 times the monthly rent. The deposit is returned within one month of vacating the flat, after deducting the landlord's claims, e.g. unpaid rent or the cost of repairing damage.

How does this differ from an occasional lease?

A standard lease requires no notary and no notification to the tax office (urząd skarbowy), but the tenant is better protected: eviction requires a court judgment. An occasional lease (najem okazjonalny) gives the owner a faster way to recover the flat in exchange for extra formalities.
