Polish–German rental agreement

Renting a flat to someone from Germany, Austria or Switzerland, or living abroad yourself and renting out a flat in Poland? A bilingual Polish–German agreement lets both parties read the same text, while the Polish version remains binding.

  • A German legal translation in the right-hand PDF column
  • Polish terms in parentheses, e.g. Gelegenheitsmiete (najem okazjonalny)

FAQ

Questions and answers

Is Polish tenancy law different from German law?

Yes, markedly – e.g. notice rules and deposit limits differ. That's why the translation renders Polish concepts with the Polish term in parentheses rather than replacing them with German institutions that work differently.

Which version applies in a dispute?

Polish – as the clause in both columns of the agreement states. Renting a flat in Poland is governed by Polish law, and the court will rely on the Polish text.

Can a landlord living in Germany sign the agreement remotely?

The parties can sign the agreement at different times, e.g. by exchanging signed copies by post. For an occasional lease, the tenant's declaration still requires a notarial deed in Poland.

Can I generate an occasional lease in German?

Yes. Choose the occasional lease in the generator – the German version includes the clauses on the notarial deed, substitute residence and notification to the tax office (Finanzamt).
