Occasional lease agreement (najem okazjonalny) – template with required appendices

An occasional lease protects a private landlord: thanks to the tenant's notarial declaration, the flat can be recovered without a lengthy eviction case. It only works, however, if you complete every formality – check the list below before you start.

  • Clauses on the notarial deed, substitute residence and the tax office
  • Fixed-term only, max. 10 years; deposit of up to 6× the rent
  • A list of appendices to sign at the notary

Before you choose an occasional lease

Without these steps the agreement is not an occasional lease – the rules of a standard lease apply instead.

  • The landlord is a private individual and the owner of the premises, and does not run a business renting out premises.
  • The agreement is in writing, for a fixed term of no more than 10 years.
  • The tenant's statement in the form of a notarial deed: submitting to enforcement and undertaking to vacate the premises on demand.
  • Designation of a substitute residence where the tenant will live in case of enforcement.
  • A statement from the owner of the substitute residence consenting to the tenant living there, with an officially certified signature (e.g. by a notary).
  • A deposit of no more than 6 times the monthly rent.
  • Notification of the agreement to the tax office (urząd skarbowy) competent for the owner's place of residence within 14 days of the start of the lease.

Fill in the agreement

The lease type is already selected – start with the parties' details.

Parties

Details of the landlord and the tenants. Leave blank any fields you don't know: the agreement will show a space to fill in by hand.

Landlord

Makes it easier to identify the parties, but you can write it in by hand when signing.

Tenant

Makes it easier to identify the parties, but you can write it in by hand when signing.

Several tenants are jointly and severally liable for the rent and damage: the landlord may demand the full amount from any one of them.

FAQ

Questions and answers

How much does the notary cost for an occasional lease?

The maximum notarial fee for the tenant's declaration of submission to enforcement is 1/10 of the minimum wage, plus 23% VAT and a fee for copies. In practice it's usually a few hundred złoty; either party can pay it, so agree on this before signing.

What happens if I don't notify the tax office?

Without notification within 14 days of the start of the lease, the agreement does not enjoy occasional-lease protection: the landlord cannot use the simplified eviction, and the rules of a standard lease apply.

Who can own the substitute residence?

Anyone who agrees to take in the tenant in case of eviction – often the tenant's family. Their statement requires an officially certified signature, e.g. at a notary. The substitute residence doesn't have to be in the same city.

Can a foreigner sign an occasional lease agreement?

Yes, and offices often ask for one in residence procedures. Designating a substitute residence can be harder for a foreigner, so prepare it in advance. You can generate the agreement in a bilingual version.
